§ 26-95. Fees.

  • (a)

    The stormwater utility is hereby authorized and directed to establish, assess, and collect stormwater utility fees upon single-family residential property, recreational property, other public facilities, and miscellaneous public facilities within the village boundaries sufficient to plan, construct, operate, and maintain a stormwater management system, pursuant to F.S. § 403.0891(3). Such fees shall be implemented upon the approval of the village council by resolution.

    (b)

    All single-family residential property shall be assessed a stormwater utility fee based on a relative contribution to need, and based on:

    (1)

    Total parcel area;

    (2)

    A measure of a parcel's runoff resulting from both pervious and impervious areas; or

    (3)

    Any other methodology that is reasonable and equitable.

    (c)

    All recreational property shall be assessed a stormwater utility fee based on a relative contribution to need, and based on:

    (1)

    Total parcel area;

    (2)

    A measure of a parcel's runoff resulting from both pervious and impervious areas; or

    (3)

    Any other methodology that is reasonable and equitable.

    (d)

    All other public facilities shall be assessed a stormwater utility fee based on a relative contribution to need, and based on:

    (1)

    Total parcel area;

    (2)

    A measure of a parcel's runoff resulting from both pervious and impervious areas; or

    (3)

    Any other methodology that is reasonable and equitable.

    (e)

    All miscellaneous public facilities shall be assessed a stormwater utility fee based on a relative contribution to need, and based on:

    (1)

    Total parcel area;

    (2)

    A measure of a parcel's runoff resulting from both pervious and impervious areas; or

    (3)

    Any other methodology that is reasonable and equitable.

    (f)

    The fees payable under this section shall be deposited in a separate village fund and shall be used exclusively by the stormwater utility to pay for the cost of planning, operating, constructing and maintaining the local stormwater management system.
