§ 20-1. Authority for providing improvements and levying and collecting special assessments against property benefited.

  • (a)

    The village may, by resolution of the village council:

    (1)

    Provide for the construction, reconstruction, repair, renovation and upgrading of sanitary sewers to serve property in the village, including any and all necessary components of the sanitary sewer system;

    (2)

    Provide for the construction, reconstruction, repair, upgrading or landscaping, of roadways, streets, pathways, sidewalks, easements, water utilities, street lighting and any or all public improvements described in or authorized by F.S. ch. 170, as if listed in full herein.

    (3)

    Provide municipal services including, but not limited to, fire protection, emergency medical services, garbage disposal, recreation, security and any or all municipal services described in or authorized by F.S. ch. 170, as if listed in full herein.

    (4)

    Provide for the payment of all or any part of the costs of any such improvements or services (referenced in subsections (1), (2) or (3) above) by levying and collecting special assessments on the abutting, adjoining, contiguous or other benefited property.

    (b)

    Special assessments may be levied only for the purposes enumerated in this section and shall be levied only on benefited real property at a rate of assessment based on the benefit accruing to such property from such improvements or services. The terms "improvements" and "services" as used in this chapter includes any type of improvements or services referred to in subsection (a) above.

    (c)

    This chapter is created pursuant to the village's home rule power conferred by Section 2 of Article VIII of the Florida Constitution as codified in F.S. § 166.021. Additional authority may be conferred by F.S. ch. 170; however, this chapter is not solely dependent upon the authority of F.S. ch. 170. Accordingly, to the extent that this chapter conflicts in any respects with F.S. ch. 170, this chapter 20 shall control.
